1) 我的問題是, 我剛收到移民局的電子郵件,說是RFE的信已寄出,但不知道是什麽.是不是寄給律師了?還是他根據經驗判斷的?
-You have to receive the RFE to see what documents the RFE requests and then, just provide what they need. Normally It probably is about your employement status. If so, just ask your current employer to give you an employment verificattion letter indicating your job title, job responsibiliteis, salary, and job starting date, etc. and then, you write a response letter (cover letter) to indicate your new job is in the same/simialr area as the old job and your I-485 was pending for > more than 180 days when you changed your job. So, based on the I-485 portability ruel of AC21, your job/employer change does not affect your pending I-485 and that is all! Don't think you need waste your money to hire a lawyer to do this for you.
2) 證明合法性,要出什麽材料? 我是在485交完一年左右換的工作.在H1Btransfer交上去後就去上班了. 陳律師的貼子上寫的是要出原單位最後三個工資單和新單位最早的工資單,證明什麽時間換的和有沒有GAP.
-Correct.
可是我的工資單都不知道哪去了. 怎麽辦呢?
-Ask the employer to indicate the job starting date in the employement verificattion letter.
轉H1B的approval notice 有用嗎?
-Yes. Provide the copy of it also and may provide a copy of the tax return you filed for that year.
