EAD: 02/01/2010 – 01/31/2011 (OPT)
H1B: 10/01/2010 – 09/20/2011
A公司去年四月份辦的第一個H1B (10/01/2010 – 09/20/2011).用EAD在A公司做到08/31/2010, 沒活兒了, 走人. 接著用EAD在B公司做到01/31/2011. B公司要為我辦H1B Transfer, 三年到01/31/2014.
材料齊全後,在12/01/2010去A公司幹了一天活,拿到一個paystub, 算是激活了A公司的H-1B. 立即申請H1B Transfer. 在01/12/11收到RECEIPT後,就接著在B公司幹活了.到現在,和將來.
PLEASE help me: EAD和 H1B並用, 我犯規了嗎?
-Yes. Your F1 status expired on 10/1/2010 when your H1 (sponsored by A) was effective no matter whether you worked for A or not and thus, your OPT EAD was invalid that time and you can not use this EAD to work anymore from that day. B should have filed the new H1 petition (effective on 10/1/2010) for you using the H1 quote you got from A even if you did not work for A. So, you violated the status law to work for B after 10/1/2010 until the H1 transfer approval (sponsored by B). Please remember one person can not have two different kinds of status at the same time.
My suggestion is that you had better go outside to get the H1 visa to come back to clear your status error record in case you may have trouble in the future.
