老師和大家好,請幫忙看看.

我在申請學校的EB1B,學校律師建議四月初把材料遞交出去,但現在我和老公有兩個問題不太明白,想請教老師和大家.

我是140的申請人,律師建議在提交140的同時我和老公同時提交485 (他覺得這樣方便和快一些). 但老公的H1B在四月底到期,這樣我們需要在485提交後再提交H4的申請來保證他的合法的身份.我們不明白這樣可行嗎?因為這樣一來485上他的身份是H1,但同時他的身份在485申請的過程中又會改變;

-If possible, he can extend his H1 before his current h1 expires. If no, he had better change his h1 status to H4 and this status change does not hurt the I-485.

我們隻申請了EB1B,沒有提交其他的申請.如果EB1B被拒的話,485也就作費了嗎?

-Correct. If you will pay all the fee (filing fee and lawyer fee), you may just file Eb1B I-140 at this time and after your I-140 is approved, you and your whole family then file I-485. If the I-140 is denied, you do not need to waste your money to file I-485 ( a lot of money). So, don't follow the lawyer's suggetions.

我們也想這段時間再準備NIW,但可能還需要一些時間.如果EB1B被拒,NIW剛剛交上,能夠把485轉到NIW嗎?
