Thank you for your further advice. Based on 212(e), J1 waiver is needed to apply for H1, (but I am a H1B holder. Why? I cannot explain it). So I am worried about the H1B extension. 

 被拒的可能性大嗎?

-Technically USCIS will deny your H1 also, but your have already had the existed H1 status and thus, USCIS may not check it carefully and approve your h1 extension (you have a better chance for H1 extension than TN application). Anyway, try anything you can because you have no choice at this point.
