My old H-1B for my previous company is still valid (am I right?) So I can just transfer that one? I have left the company at the end of 2008.

-You can not use that H1 to do H1 transfer because you have left that company though the h1 approval is still valid but your h1 status with that company was over.  You had better wait for your current employer to fix the problem for you and then do the h1 transfer. If you ask your new employer to do the h1 transfer for you now (assume your current h1 has been withdrawn),  most likely your h1 transfer approval will have no I-94 and thus, you need to go out of US to get the H1 visa to come back
