H1-B到今年八月滿六年,公司準備給辦綠卡. HR說PERM必須在H1-B滿六年之前的前一年,也就是滿5年之前遞交,否則不能再遞交。

我的理解是:如果滿5年之前遞交,在6年滿之前還沒批的話,還可以合法工作。如果象我這樣,也可以遞交,隻是如果再滿6年後還沒批的話,必須離境。我的理解對還是HR的理解對?
-You are right. If your can not get the your I-140 approved before your 6 year H1 expires, you can not extend your H1 beyond the 6 year limit and thus, you cna to go outside US for one year. One solution is that, you can change your status to another non-immigration status such as F1, H2 etc. (or just leave US) before your h1 reaches the 6 year limit, then change it back to H1 with extension beyond the 6 year limit (or return to US to extend your H1 beyond the 6 year limit) when your PERM pending is for one year or the I-140 is approved (you can use premium processing to get the I-140 approved in 15 days if the PERM is approved).
