My old H1B (I-94) was expired in September, and the H1B extension is still pending though it was withdrew in Septempber. My new H1B transfer was in early October (after I-94 expired) and started to work at the end of October.
My H1B is just approved without I-94 (email, the formal USCIS letter is not received yet). So I stoped working for new company.
-You need to get the formal approval notice (paper document) for the H1 visa application.
Since there is a gap between 2 H1Bs, what documents should I take for visa and what should I pay more attension to?
-Bring the h1 extension receipt (the one withdrawn) with you in case the VO asked your legal status gap in US.
Is there more possibility to get checked due to the gap?
-No. Irrelevant.
What if I was asked for I-94 (expired)? Can I leave USA without a I-94?
-Provide any one of your previous I-94s (old one) to the airlines when you leave US.
In addition, I need the PIMS verification for visa. How could I know whether the attorney applied it (he said he did)? Is there some proof I should show to the immigration officer?
-Not need to do anything by yourself. Normally, your lawyer/employer filed two copies of the H1 petition to the USCIS and then USCIS send one copy to the the Kentucky Consular Center (KCC) when your case is approved. Thus, ACC will scan the h1 petition and approval documents and put them into PIMS. So, after a few days your case is approved, your H1 information will be in PIMS. So, you do not to worry about that.
