h4 pending 轉h1 必須539 先批準嗎?請問老師們 怎樣駁辨律師的錯誤理論

根據我學習皮匠老師博客後的理解,肯定是不需要的.隻要在h4批準以後再去一趟墨西哥就可以了.但是公司的律師說Although we are requesting premium processing, the H-1B petition may not be approved within the 15 day period as the I-539 application has to be approved before they can approve our H-1B petition. 


請問有什莫紅頭文件可以讓我引用,告訴律師她的理解是不對的.她現在講我的start date必須推遲,搞不好我的offer要被她搞黃.請老師們一定幫忙.非常感謝!
