Lost job one month before my H1B expired(September), my old employer withdrew the H1B extension in September (still show pending). The new company filed H1B transfer (premium) at the early Octorber (1 week gap) and got RFE (to prove the job is real). I am now working at new company based on my pending H1B extension.
The lawer wants me to show the badge and email to prove the real job (the manager of the new company is not available to provide a letter), so I started to work. Do you think it is OK/necessary to show bage and email?
-You have no choice, right? Provide any evidences for your job such as offer letter, your recent paycheck stubs, etc.
Is it possible to get denied if they find there is a gap of 1 week between 2 H1B (though the extension of the old one is pending) and I am working now?
-I do not see this will be a problem.
The lawer told me to stop working as soon as the USCIS formallly withdrew the H1B extension (internet). Thanks a lot!
-You said you used premium processing and your h1 transfer will be approved shortly after you respond to the RFE. So, I do not think you need to stop working unless your transfer approval has no I-94 or is denied.
