【公告】 EB3C 集體訴訟進展(截至10月中旬)

 

9月27日，西華盛頓州聯邦法庭對li v USA案開庭。作原告的審前動議，及被告的撤案申請進行了庭辯。

在當天的庭辯中，法官的提問著重圍繞聯邦法庭對此案件的判決權限、判決的可行性，以及援引典型案例的適用性展開。

 

庭辯結束兩周後，政府遞交了一份SUPPLEMENTAL BRIEF，大意為兩點:

1)2000年和2005年Recapture的13萬和5萬名額用完了

2)Recapture要國會通過。例舉了議員和USCIS的Ombudsman話 “These visas go out of existence and cannot be recaptured except by an act of Congress。”

 

我方律師準備這樣回複政府的SUPPLEMENTAL BRIEF：

1)從1997到2006年還有216,000名額可Recapture。

2) 議員的一句話不是法律。我方聘用當年USCIS的Ombudsman作專家證人指出：

In my 2008 Ombudsman Report, I state that absent special legislation, such as the American Competitiveness in the Twenty-First Century Act (“AC21”), unused visa numbers cannot be reclaimed.  Where the demand for visa numbers is low and not all visa numbers are used because there are not sufficient applicants, that is correct.  Thus, for example, if there are 140,000 EB visa numbers available in a given fiscal year, and there are only 100,000 EB applicants, then the additional 40,000 EB visa numbers cannot be recaptured except through special legislation.  However, where the demand for visa numbers exceeds the supply of visa numbers available for a given year, and where the visa numbers available are not used because the agency fails to process applications, a court can order that the visa numbers be recaptured.  This would be consistent with Congressional intent.

 

我方律師建議法庭從往年Recapture名額中補償EB3C的損失，意義在於把216,000用COURTORDER開一先例，此案若能勝訴，以後援引此案例，用各種範圍和理由的訴訟Recapture名額，不僅僅限於EB3C。

 

這次回應付律師費$2000，專家證人費約$2500。捐款尚餘$5000多，還夠一個回合。歡迎大家捐款，支持該訴訟，在法庭上與DOS&USCIS見分曉。
