我老公持H1有效期到明年6月，現突然被解雇， 因短時間內不可能馬上找到工作或轉換其他身份， 他是否必須馬上離開美國？有多長時間做回國準備？

-After he lost the job, technically he is out of status. But he can legally stay until the I-94 expires (明年6月). The problem is that if you are out of status is too long, it may affect you to get the visa outside US to enter US again. Also, you can not get back to a non-immigration status within US after you are out of status even though you are legal to stay. So, you had better leave US as soon as possible after you are out of status or change your status to another non-immigration status as soon as possible (within one month/before the employer withdraw the H1).

我持H4有效期也到明年6月，我是否也必須同他一起馬上離開美國？

 如果我想呆到明年6月，是否合法？如果不合法，因為已超180天，我將3年內不能再進入美國， 對嗎？
