My current I-94 on my H1B is valid to 9/23/2010 (one week left). Even if I got the offer, it will take 1 week or longer to prepare H1B application. Is that OK if the valid date passed when transfer my H1B to new company? Or Should I leave USA to reapply a new H1B?
-Fine. A few weeks of gap is OK for the H1 transfer. Even in the worest, you h1 transfer will be approved, but may have no I-94. If so, you just go outside US to get the H1 visa to come back to activate the h1 status.
I am planning to transfer to F2 next Monday (9/20)?
-Not need if you are sure you will get a job offere very soon.
But I cannot work immediately if I get the offer.
-Use premium processing to get it approved within 15 days and then you can work. Also, you can work after the new employer after the h1 filing and if your H1 approval has no I-94, you can stop working and go outside US to get the h1 visa.
