我是美國公民。我侄女20歲了。如果我現在為我哥嫂申請移民，我侄女到I-130批下來肯定過二十一歲了。

但他們的I-130優先日期應該在我侄女21歲生日前。
-This is not helpful. The critical thing is the priority date (PD) has to be current before the CSPA age reaches 21. Because it may take about ten years for your I-130 PD to become current, your侄女 CSPA age will be > 21 (out-age). Thus, she can not get the immigration visa as her father's derivative status.

The CSPA age = your 侄女's age at the time of the PD is current - the time of the I-130 pending



如果我侄女在他們一家移民前不結婚，她受“CHILD STATUS PROTECTION ACT OF 2002”法保護嗎？多謝了！
