245 (i) only applys to the people who filed the immigration application before/on April 30, 2001. So, your case is not qualified for 245 (i).

But you may try to file I-601 Application for Waiver of Ground of Inadmissibility if you finally do not get the GC after you try all your effort. One problem is that it is very diffcult to get the I-601 approval. Anyway, discuss it with a professional lawyer before you take any action. of course, you can also wait for your spouse to become a US citizen and then sponsor your GC.
