I was layoff yesterday. My wife is F1.
1)My perm is pending. The company told me that they will not withdraw that. If it is proved, I can use the priority date. Is that true?
-Not true. Only if your I-140 is approved, then can you use the priority date for another new I-140.
If I find another job, the new company will have to file a new PERM
-Correct.
or use the old one and priority date?
-No.
What if the new salary is lower than my old perm.
-Irrelevant.
I do not have the case number, should I ask the company lawyer? He did not want to tell me the case number while I am working.
-Not need the PERM infromation because it is useless to you after you are laid off.
2)Should I transfer to F2 immediately?
-If you can not find a job very soon (e.g. within one month), you had better do that.
What if I find a job in two weeks?
-Then, you have no problem to do the H1 transfer and do not need to do F2 application.
3)If I find a new job, while my application of transferring to F2 is pending, how can I withdraw the F2 application and start a H1 application?
-Then, you H1 transfer may be approved without I-94 and thus, you need to go outside US to get the H1 visa to activate it.
