You may be exempt from cap if you can meet the followings:

You need to show the proof that you have been in status since your last entry. What was your status and the status after that when H1 began and you did not work for the petitioner? And did you have status gap? and if you did, did you re-enter with a visa stamp after that gap? And were you ever out-of-US for a long time since 2001?
