回複：F2--EAD--H4?

在請教各位老師前先說說背景情況：

在我讀書期間，我的孩子是我的F2，並作為丈夫（H1B）的dependant交了485申請。我今年五月畢業。在今年畢業前，我於去年九月用485 pending 申請EAD開始工作；同時我的孩子也於去年暑假申請了EAD並用該EAD卡申請了駕照和社安卡。請問：

1. 現在我孩子的身份是AOS 還是F2？
-Because you used EAD, you lost your F1 status (your status is AOS) and thus, your kid lost his/her F2 status and thus, your kid status is AOS.

2. 我孩子明年11月申請大學，假如排期還未到（PD 09/2007），我們可否為孩子申請H4以防485被拒孩子還可以繼續在美讀書？
-Your kid can not change his/her AOS to H4 (or any non-immigration status) within US. If his/her I-485 is denied, he/she just go back to China to get the H4 visa to come back. So, nothing worried about at this moment.

3. 假如可以申請H4,在I-539上“是否申請過移民簽證”一欄我是選yes 還是 no?
