我姐於2002年為我申請姊妹移民,I130於2009年12月批準.按現在的排期,還有大約一年排期到了.但我女兒今年年底即滿21周歲.我的PD是2002/7.我和我先生和女兒分別於2001年和2002年來美,一直以H1B和H4 身份居住至今.
我的問題是
1.聽說有兒童保護法,我女兒是否適用
-Yes.

是如何計算移民年齡?
-the "Child Status Protection Act" (CSPA) age = the child age when the PS is current - the I-130 pending time. For example, assume your priority date (PD) becomes current in December 2010 at you child' age 21, then, your child's CSPA age = 21 - (Dec. 2009 - July 2002) =21 - 7 yr 5 mon = 13 yr 7 mon
2.如果排期到我們三人是否可同時提交I485?
-Yes as long as you all keedp your status valid until the PD is current.

3.一般情況下,I485需多久能夠批下來?
-Depends on whether the PD turns back or not. Normally several months.
