I have the question about my H1b extention after 6 years. I used AP in 2008 and now my I-94 was expired(06/2009). My H1 will expire on 10/2010.
If my H1 ext approved, what will be my I-94 number?
-This new number will be shown in your I-94 with the approval notice of the extension. Your current I-94 number the one you entered US using AP (expired on 06/2009). so, fill this number in the Form I-129.
Will be the same as I entered to U.S.A?
-Maybe not, but it does not matter, anyway.
But it was expired. Any problem with that?
-No problem at all. When you provide the passport pages and the I-94, USCIS will know this number is for Parolee after using AP and thus, it will not affect your h1 extension.
Of course, you also need tp provide the copy of the old/current h1 approval notice with the H1 I-94 (expired in 10/2010) for the h1 extension petiton Thus, USCIS will be not confused.
