小弟剛剛被公司Layoff，公司答應再給兩張paycheck,一張在七月中，一張在七月末。我自己是在485 pending, 好像還可以繼續找，而不用必須在七月末以前找到新工作或者轉換身份（當然一定盡力！），不過老婆拿的是H-4 （當時我file 485的時候我們還沒結婚），所以我正想辦法給她保持身份 - 她剛剛拿到一個學校的graduate program admission, 所以我們準備file change of status to F-1, 不說F-1 status最多能提前start date30天生效,所以在COS的cover letter中我們申請她F-1 status的開始時間為8月1日（她的I-20上是9月1日）。但是我們也聽說這種COS申請通常要幾個月才能批準，那麽這中間她的F-1 status還在pending,而我八月一日後已經沒有H-1,會不會有問題？
-No problem at all. As long as she files the change of status (H4 to F1) before her H4 is invalid, she has not status problem even if her f1 is apparoved after her H4 is invalid.

USCIS如果能批準她的F-1 status, 會不會考慮把她F-1的開始時間設為8月1日，還是會把開始時間設為批準時間（幾個月後了）？如果真的是後者，我們有什麽解決辦法哪？
-No matter what effective date is, she is OK. But she needs to enroll the full-time course in the Fall semester to keep the F1 status valid (she can enroll teh school before the F1 approved). Talk to the school international office and ask for help for the change of status from H4 to F1.

希望863211老師，Pjiang老師，和各位朋友能給我們一點啟示！以前經常聽大家說，H-1B身份出問題，可以轉F-1,但現在事到臨頭，真的不太明白這裏的程序，如果是不能我們request新身份的開始時間（當然要和I-20上一致），那豈不是走這條路的人都會有問題 - 因為F-1 COS總要幾個月才能批準吧，而誰又能在出問題的幾個月前就申請哪？

請各位老師多多指點啊！小弟不勝感激！
