我的H1B明年7月17日第六年到期，不過可以recapture三個月。我老板同意為我申請labor certificate，但是最快也要今年7月17日以後。如果能在10月17日前遞交申請，明年10月到期後labor certificate還沒有批的話，我能申請延期嗎？
-As long as your PERM is filed for at least one year (not need to be approved), you can extend your H1 beyond the 6 year limit for at one year interval.

Please remember that the PERM position need to be advertised for about one month and the prevail wage determonation for PERM normal takes two months to be approved, the time is very urgent for your employer to process the PERM for you. If the PERM can not be filed before Oct. 17, you had better visit China for a couple of months to save more H1 time ( recapture the H1 time during your visiting China) so that your 6 year h1 will not expire before the PERM pending reaches one year. Thus, you can extend it after the PERM is filed for > i year.
