new job with different title needs new h1b. was told it won't take too long. now that the offer letter is here, new employer says it takes at least two months to get it approved by department of labor, then two weeks by premium service. is that true?
-Not true, your employer messed up the prevail wage determination for LCA (H1) and for PERM.

Your employer/lawyer can either get the prevail wage for LCA/H1 online in a few seconds at http://icert.doleta.gov or from OES data resource (http://www.flcdatacenter.com/).

Then, fill the prevail wage in the LCA application and send the LCA application online or by mail to DOL for approval. Normally LCA applicaiton takes one week to be approved. After the LCA approval, the H1 petition can be filed and you can work for the new employer after USCIS receives the H1 transfer petition (not need to be approved for you to begin working).
