H1b question, 863211 please!

I started working using OPT in January 2009. My employer applied for H1b for me in April and got approved. But then I lost my job in August while still using my OPT.

In October, 2009, I asked the attorney that handled my H1b application to see if my employer revoked my H1b. She told me I became H1b since Oct. 1. and technically became out of status since the day I was laid off. But I filed i-129 and went back to F1 until now.

I recently got a job offer and they would sponsor me. I will talk to the new job's attorney about getting h1b now. Should I ask them to do change of status (f1 to H1) or getting new applicaiton for me? My jobs are all in industry (cap). Any risks? What is the best to do?
