回複：緊急問- 老婆的H4過期了怎麽辦

怪本人太想當然,以為H4是依靠H1B的,本身就不需要辦理了.我原來的H1B於今年3月底到期,H1B在到期前申請延續了.但是沒有同時辦理我老婆H4簽證的延期,公司找的律師也沒有跟我提過這個事情.我自己的H1B在5月初批下來了.但今天才知道H4也是要申請延期的,現在我老婆I-94上的到期時間還是我原來簽證的到期時間3月底.

難道我老婆是黑身份了!!?

現在要怎麽辦?怎麽辦?
-Leave U.S. as soon as possible an apply for an H4 visa outside US to come back. Explain to the visa officer why she was out of status if asked.

老婆的H4還能延期嗎??
-USCIS will not approve her H4 renewal application due to the unlawful presence. So, don't waste her time to file the application within US because the unlawyful presence continues even if she files the H1 renewal application. Once it is > 180 days, that will be big problem.
