我的情況是這樣的，140 approved, 485沒交，H1B第七年（基於140的三年延期）。太太剛開始工作，單位這個月給她交H1B申請。我們公司最近可能要在七月中旬裁員，如果是這樣的話，我就隻能轉成H4。請問：
第一：我已經申請了140，H4有可能因為移民傾向被據嗎？
-No. Like H1, H4 is alos dual intent.
第二：如果我申請H4的時候，我太太的H1b還沒有批準，隻有收據，receipt number就足夠申請H4了嗎？
-Yes.
還是說一定要有H1的797A才行？
-Not need.
第三：加入我轉成H4之後，又找到其他公司的工作，還可以基於原來的140申請三年H1b嗎（假設舊公司不撤銷我的140）？
-I am not pretty sure because USCIS has not specific explanation. But from my own opinion, you may not be qualified to get back to the H1 again because your 6 year h1 has expired. You can contniue your H1 extension/transfer beyond the 6 year limit with the I-140 approval if you keep your job, but if your H1 status is terminated beyond the 6 year limit (such as lost job), you may not get it back again. Of course, this is my personal understanding and you may talk to your lawyer to see what he/she thinks.
