我的朋友目前是post-doc第三年，H1-B身份。他的H1-b身份是今年6月7號到期。三個星期前由學校的IPO 國際辦（在麻省的學校）給遞交申請H1-b 的延期。前天他收到學校國際辦的email，通知他說他的H1-b不能辦。原因是，波士頓的H1-B處理中心說他的salary太低了，不符合H1-B的審批條件。他目前的年薪是4萬刀，這對一個post-doc來說很正常，而且他去年和前年的salary比這個還少，他申請H1延期也沒碰到這個問題。

學校的IPO的辦事員也說第一次碰到這個事。
-USCIS changed the prevail wage determination method in January 2010. The 學校的IPO的辦事員 might not know this and make a mistake. You need to go to one of these websites to find the prevail wage:

If he find his cuurent salary is higher than the prevail wage, his H1 is OK. If not, he may change his job code to find a lower prevail wage to match his actual salary for the H1 petition.

He had better find a lawyer to help him out because I think the 學校的IPO的辦事員 may have no experince.

1、有什麽辦法能讓他在這兒維持身份？
-See my above suggestion. Another choice is to file a part-time H1 to keep the status. If he has no time, just use premium processing to get it approve within 15 days. If his H1 approval notice has no I-94 due to delay filing, he just needs too go out of US to get an H1 visa to come back. So, nothing worried.

2、如果轉J1，他需要先回國然後再入境嗎？
-He can do the H1 to J1 within US, but is not a good choice. I would rather file part-time H1, not J1.

一般H1 轉J1要多長時間？
-2 to 3 months.

3、他申請了NIW的綠卡，140批了，還沒遞交485。這個對他有幫助嗎？
-Irrelevant.

4、為什麽Boston中心要據他？是不是有什麽新規定了？還是他是第三年post-doc 工資要提高才能符合條件？
