我的H1B到2010九月底滿三年. 我現在隸屬於加州的一間小IT公司,但是作為consultant在康州為客戶工作.

我的朋友講,因為美國的就業市場很壞,我renew申請有很大的可能被拒絕.

我的PERM批準了,I140 is in processing.

我的問題是:
1. 我的朋友講的是否屬實? 被拒絕風險真的很大嗎?
-It is true that USCIS is more strict in H1 processing, but it does not mean your H1 will be denied.

2. 如果是風險很大,那麽有沒有減少風險的舉錯?
-Talk to your lawyer and the employer to prepare the H1 application documents carefully and justify it details, and that will be fine. Not need to be panic because most of the H1 applications like yours are approved.

3. 假如被拒絕,我離開美國後,那麽我的PERM和I140是否就作廢了?
-No if you will work for the same employer later.

4. 假如以後我再持H1B來美國工作,是否還要重新申請PERM和I140?
-Yes if you will work in a different employer.
