863211,
I am an F1 college student and graduate this may 2010. I will take graduate program this fall ,2010 at the other University. My parents applied I-485 for me as family member , but It seems that I have age out problem.
Could I apply for new I-20 for the graduate program?
-It seems you have filed I-485 and thus, your F1 status transfer may be denied (not be approved) in the new school due to your immigration intent.
If I apply for and get I-20, is there any possibility for me to have any trouble, such as 485 delied because of new I-20?
-No. If you are lucky to get your F1 status extension/transfer within U.S., your I-485 will not be affected unless you leave US and get an F1 visa to come back.
What I should do for this confusion situation?
-Not good choice available unless you can find a job and get the H1 status if both your I-485 is denied due to age-out issue and also you can not get the F1 status due to your immigration intent.
Thank you so much for your help.
Jeo
