請教Pjiang 或863211等老師關於女兒上大學身份以及 EAD 問題

Our current status: EB3, I-485 pending.

1. My daughter will go to college soon, can I just keep her status as H4 (I-485 pending) and apply EAD for her only so that she is able to work at University?
-Yes, but if she works using EAD, her status will be AOS, no more H4 and it does not affect her to stay and study in U.S., anyway.

2. Can I just apply EAD for her only?
-Yes, of course.

Or I have to apply EAD with her together as the primary applicant?
-No.
(In order to reduce cost, I would like still use my H1B to work, instead of apply EAD with her together.)

3. I don’t think I can apply F1 for her because of our I-484 pending status, is it right?
-Correct. Just use EAD to work on campus or off campus.

4. Is there any disadvantage if she is going to use EAD to work at College and what will be happened if our I-485 will be denied while she uses EAD to work at College in future?
-She can go out of U.S. to apply for the H4 visa to come back to reinstate her H4 status if her I-485 is denied. So, as long as you or your spouse keep your H1 status, your kid status will be fine no matter what happens to her I-485.

5. Can we apply financial aid at I-485 pending status?
-Yes, if she use AP to travel outside US and come back to get a Parolee status (Parolee I-94), she can be qualifed for application for the Federal financial aid..
