我當時是持K1未婚妻簽證合法過來的，過來後他拒絕結婚，簽證到期後我沒回去，非法滯留下來了（我同學在這裏，就待在同學那裏了，忘記簽證到期的事了），應該是合法入境，非法滯留（應該都屬於非法移民吧？），在這種情況下，也不能與美國公民結婚，以此拿到綠卡吧？
-Your problem is different from非法入境, but the consequence is the same because you entered US with K1 visa, not onther visas e.g. B2, F1, etc. As the K1 holder, you have to marry to the US citizen who sponsored yoru K1 visa within 90 days after you entered U.S. But you did not get married with that person, so you were supposed to leave U.S. You can not get your immigration status (green card) by marrying another US citizen unless you left U.S. before the new marriage. Now you has been unlawyful presence more than one year, so if you leave U.S., you will be banned to enter U.S. within 10 years.
