回複：請教皮匠或863211老師：Eb1a 485的遞交時機

EB1A 140批了，本來最難的一關過了，應該歡天喜地的遞485。但是工作出了點問題，未來幾周有失業的危險。這種情況下應當選擇什麽時候遞485，幾個問題如下：

1） 140有沒有expire一說，
-No.
就是說是不是必須在140 approve後若幹時間內遞485，否則會失效？
-No time limit to file I-485.

有的話，是多久？

2）如果迅速遞了485（在可能的失業前），
-if you do not change your status to another non-immigration status (e.g. H1 to H4) when you are laid off, you have to file your I-485 before you are laid off to get the AOS to stay. But you may get the RFE after you file I-485.

但由於RFE來時沒法提供EVL或者新的offer，485不幸被拒的話，以後找到工作再申請綠卡是從140重頭開始，
-No.
還是原來的140繼續有效，再file 新的485就可以了？
-Yes, but you need to have a non-immigration status or parolee status to be qualified for another I-485 filing. So, if you can change your status to H4, you may not file I-485 until you find a new job in the same/similar area.

3）EB1A的485是不是會快一些，目前大約多久啊，期間一定會收到RFE嗎？
-Case by case, but should be in a short period of time after you file I-485 because the PA is current for EB1A.
