The law requires the employer need to report to USCIS to terminate the h1 employee status if the h1 employee is no more hired. Otherwise, employer needs to continue to pay the h1 employee's salary even if the employee terminated the job, but no other penalty, and that is why some employers do not report that to USCIS if the laid-off h1 employee does not request the salary after he/she is laid off.
