wage lower than prevailing $4000 may abe big problem, but as you said if this is normal at the company, then a good lawyer should be able to find the way to use the "normal" in company as prevailing wage.
this year a little bit later than 4/1 to submit probably OK - i don't expect the quoto will be used ot too soon.
also remember by law it appears some fees (to USCIS) must be paid by employer not you.
