Yes. it is true you can work for the new employer after you file the Cap subject H1 transfer. But the risk is that you can oly work for the new employer during the H1 transfer petition is pending, and you ahve to stop work after the H1 trasnfer is apprved and before it is effective, so if your old employer inform USCIS to cancel your old H1 after you quit the job, and then, your new h1 is approve but not effective yet, you will be out of status during that perido of time.
For example, you file h1 transfer from cap free to cap subjected on April 1, then you can work for the new employer begining on April 1. Then, your H1 transfer is approved, on May 1, but effective date is Oct. 1. Also, your old employer inform USCIS to cancel your old H1 status on April 2.
Now your situation: You have to stop working for the new employer on May 1, and can only continue your work for the new employer begining Oct. 1.
The problem to you in this situation: you do not have a legal status between Aril 2 and Oct. 1. So, you have to leave U.S. after May 1 and get an H1 visa to come back at the end of September.
