我和兒子他爸2003年離婚, 兒子歸我. 然後我又結婚了 (已七年). 兒子在大學二年級, 年底將滿21周歲.
我和兒子想幫他爸辦綠卡. 我和兒子都是在2007年成為美國公民的.

兒子他爸1997年來美國, 拿了一個碩士學位, 在大公司幹了一年, 被裁員, 又去學校拿了另一個碩士學位, 未找到專業工作, 身份黑掉已近五年了. 這些年, 他主要是寫書 (未發表), 做私人家教維持生活.
從2005年起, 他沒有再填稅表.

請問在此情況下, 什麽是最好的途經幫他辦綠卡 (擔保):

1. 兒子近二年打工收入, 不足 $8000. 他有2008年和2009年的稅表
2. 我有現鈔, 打進兒子的帳戶, 要多少才好?

3. 我有近6位數的年收入, 我和兒子做共同擔保人,好嗎?
-Fine.
會否引起移民官反感?
-No.

4. 我有好朋友想做共同擔保人. 是她好還是我好?
-You are better.

5. 身份黑掉已近五年了, 付 $1000 的表格(I-245 i) 在哪裏? 叫什麽表格?
-Not need to file I-245i and not need to pay the fee. As your kid's immediate relative, your ex-hu*****and does not need to have a valid non-immigration status to get his GC under his son's sponsor as long as he entered U.S. legally (e.g. using a valid visa, etc.). That means your ex-hu*****and's unlawful presence does not affect him to get GC within U.S. in this case. So, just file I-130 and I-485 concurrently.

6. 想加急辦理, 表格在哪裏? 叫什麽表格?
-There is not premium processing (加急辦理) for I-130 (family based GC application). Premium processing is only for certain I-140 petitions or H1 petition.
