It is hard to say the officer will accept your lawyer's explanation because this is not an official procedure to deal with the denied case. If the officer does not accept your lawyer's explanation, the only way for you to do is to appeal and thus, you can keep your priority date to extend your h1 beyond the 6 year limit. The appeal may take one year to get the result, but it does not hurt you if you win case appeal because you can keep the priority date. Also, I think you have a big chance to win the appeal based on what you des-cribed here. So, do not worry too much and ask your lawyer to file the appeal as soon as possible.
