We do not have to get a prevailing wage determination, but there are reasons to do it because it then cannot be challenged.

However, we can use other wage surveys and they do meet the requirements.
-True. Each H-1B application requires a prevailing wage determination. It can be done via the new prevailing wage determination center at the DOL; or it could be done instantly by using one of the OES data sources.

We DO have to file the LCA, however, and there is a memo from USCIS saying if we don't get an approval within 7 days, we can file the H-1B with the receipt for the LCA.
-True. The USCIS will temporarily accept H1B cases for filing, even before the LCA is certified.
