if i do not have 485 pending, the gap will be not legal.
- This gap is fine even w/o pending 485.

because i have 485 pending, the gap is legal, BUT i will have to use my EAD card to work, rather than H1B transfer.
- I suggest you use H1-B transfer, instead of EAD card, so you can have a backup to yoru 485.

There is no reference of the grace period, but your 2 months gap should be fine as long as you do not work during this window.
