回複：離境1年重新申請

H1-B第五年，公司不給辦綠卡，想現在離開美國，一年後再過來重新申請H1-B，請問-pjiang，小白兔，863211，　“一年”是指連續的一年還是累計的一年，我公司的律師說的是連續的一年，中間不能回到美國，哪怕隻呆一天。是這樣嗎？謝謝！
-Your lawyer is absolutely wrong! Based on the immigration law, 8 CFR 214.2(h)(13)(i)(B), making short trips as visitor is not a problem. You just need to add the time spent in the US to the 1 year (cumulative to reach total one year).
