I've asked this question and got some help here. But I'm still feeling confused.
1) I used to use TN, company applied H1b and I got it, but I did not get chance to activate it. So when I was laid off, I still used TN.
2) I filed a I539 for H4, and now I'm on H4 pending
Question
1) Can I do H1b transfer in this case if I found new company?
2) If I can, premium processing is two weeks, am I right?
3) If I can't transfer H1b, I can file a TN premium processing, which is two weeks too?
4) Can I go to the border to apply TN if I'm on I539 pending?
5) If I got H1b or TN in 2 weeks, I can withdraw my I539 since it supposed to take 2.5 months. However, I saw someone has the experience that USCIS made mistake, was granted H4 again after got H1b or TN. In this case, what can I do?
5) The old company's attorney suggest to do H1b transfer and withdraw I539, I'm not sure why not TN, they said it's up to the company how much they would like to spend, is premium
