AC 21 job changing - Online waiting, Pjiang please help!

485 > 180 days, pending, recently moved from Fiancial department to marketing in the same company. Company atterney suggested that they belong to different job category, and may not be qualify for AC21 - Any suggestions on how to make it work? I really wanted the marketing job - the skills needed in both jobs are similar, and the job function is overlapped some. Tons of thanks!
