回複：H1-B 到期問題

我有幾個關於H1-B問題,我妻子的H1-B在2011年7月到期,現在已經用H1-B大約4年半了.公司在剛答應給辦綠卡後被賣掉了,新公司不給辦綠卡.我剛工作,綠卡申請也沒開始.即使申請綠卡,EB1和EB2 NIW 也不適用於我.

我知道H1-B用到5年必須開始申請綠卡,現在看不可能了.
-Not really. You can use premium processing to get the I-140 approved within 15 days and then, file the h1 extension for another 3 years beyond the 6 year H1 limit.
我妻子是學會計的,有碩士學位.不知到怎樣維持工作身份.
-She may find a company who agrees to sponsor her green card application. If she can not apply for the GC (PERM) one year in advance before the 6 year H1 expires, she can use premium processing to get the I-140 approved and then extend her H1.

1)我聽說離開美國滿一年,可以重新申請H1-B.是不是僅限於H1-B 6年用完後?
-No. Anytime you leave U.S.for one year outside US, you can get another 6 year H1 period when you come back.
我妻子的H1-B還有1年半的時間.如果現在回國,一年後回來是不是可以重新申請H1-B.
-Yes.
當然,我知道也要受名額限製,要取決於在在接近10月份時找到工作,而且H1-B還有名額.所以很困難.Non-Profit 公司也許可以試試.

2)離開美國滿一年,是不是必須回到中國,去加拿大可以嗎?
-Any country is OK.

2)H1-B 6年期限是不是也包括Non-Profit 公司?
-Yes.
我的意思是如果現在找到了non-profit 公司,H1-B是不是也被記做了4年半?
-Yes.

3)如果換個專業讀個Master,可以申請另外一個OPT嗎?
-No.
我妻子的OPT在讀會計時用完了.印象中好像是不能,隻能適用更高的學位 PHD.
-Correct.
