1. The I-130 for your brother does not affect your nephew because the nephew is not the direct/primary beneficiary. Immigrant intent can be used to deny your brother's visa, however, your brother's own financial and social status in China will also dominant VO's decision to issue or deny a visa even when he has an I-130/I-140 (as long as PD is not current, CP not started, no I-485 filed).
2. Your nephew has to maintain legal status at all time while in US, otherwise he is not eligible to adjust (do I-485) in US when the time comes.
3. It will depend on the i-130 processing time and PD, too early to tell.
