回複：走投無路，H1六年後離境1年重新申請H1的問題

我的六年H1明年10月1日到期，因為沒有申請綠卡，隻能明年(2010年)9月底回公司中國分部工作一年，我的問題是2011年4月份公司能為我申請2011年10月1日開始的新的3年H1嗎，因為到2011年10月新H1生效時我就滿足出境一年的條件了，但是在4月份申請時隻離境了半年，會被批準嗎？
-It should be OK because the h1 is effective on Oct.1. But if you can ask your employer to file PERM for you now and then you can use premium processing to get your I-140 approved, you may still have time to extend your h1 beyond the 6 year limit. Even if you go back to China to work, the PERM and I-140 appication is still valid, and thus you can file I-485 when you come back if your PD become current.

So,, just go ahead to do the green card application as soon as possible.
