Can I do it now.

What the lawyer said made a little sense. Becasue even if my wife transferred her H-1B, she is still in status of H-1B. And on my daughter 's H-4 approval letter, I did see any relation between her h-4 and my wife's specific H-1B.

Anyway, can I still transfer my daughter's H-4 to my H-1B.
