我目前在大學工作，做postdoc。剛剛工作一個月。現在有個工業界的offer。今天跟移民律師談 h1b transfer的問題。
1）我問律師，我剛剛在這個大學工作一個月，辦 h1b有風險嗎？我好像聽說有至少要工作倆個月的規定。可是律師說沒問題。我怎麽覺得這律師有點不靠譜啊。
倆位前輩覺得這律師說的對嗎？

2) 後來我又跟律師說，如果我用premium來辦理H1B tranfer。那樣我就可以很快知道結果是批還是據。如果批了，就去工作。如果據了，就還留在現在這個大學做postdoc。
可律師說，如果transfer被拒，也不能再在現在所處的大學工作了。
-The lawyer is absolutely wrong and you of course can work for your current employer if the new H1 petition is denied. Because each person can have several h1 status at the same time, you may just ask the new employer to file a new H1 petition for you, not do the h1 transfer. Thus, it will not make confused. The difference between the new h1 petition and the H1 transfer is that you can work for the new employer immediately after you file the H1 transfer, but you can only work for the new employer after the new H1 petition is approved.

Because it is risky for you to work for the new employer before your new H1/H1 transfer approveal, it is not different to you whether your new employer file a new H1 or do h1 transfer.
