回複：父母b2 簽證來美， I-130 已批， 如何在美國獲得綠卡而不必回國？

我的大哥是公民， 申請父母移民，但很不幸， 最近因車禍去世， 我辦理父母B2簽證來美處理後事， 到達美國一個月後，告知移民局已批準I-130， 請問在這種情況下， 應該如何處理？

After your brother's death, USCIS will revoke the approved I-130 unless the Attorney General in his discretion determines that for humanitarian reasons revocation would be inappropriate. Also, I do not think the humanitarian reasons would apply to your parents at this movement. So, your parents's green card applications would be revoked/cancelled.

是回國按照正常的程序等待呢， 還是可以在美國這裏申請身份調整， 在這種情況下還要重新找個sponsor嗎？
-Only you (or your other US citizen brothers/sisters, if any) can be the sponsor for your parents' green card application after you become US citizen. No any other people can be your parents' sponsor for the green card. So, your parents may need to go back to China after their visa expires. Of course, they can stay illegally in US until you become a US citizen some time later, and then you can sponsor them to get the green card (their unlawful presence does not affect their future green card application no matter how long it is).

但我的身份是h1b, 聽說最好找個公民親屬做sponsor ?
- 公民親屬 is not qualified to be the sponsor unless he/she is your parents'kid.
