我的LCA被拒了因為律師的低級錯誤，現在在等第二次LCA，可能要9/29才有結果。
我的H1B 9/30 過期。想請教您下列問題：

1）如果9/30那天不能送出延期申請， 10/1以後我有身份問題麽 ？ （有AOS）
-Technically, you are out of status. But you should have no problem to get your H1 approval for only these few days (H1 has ten day grace period after it expires).

2）需要申請H4 作為 backup麽？
-Not need.
3）如果 9/30送出了延期申請，但是不可能拿到receipt notice， 10/1後還可工作麽 ？
-Technically, no. But practically, yes because your H1 extension will be approved fully with the I-94 and thus, your status has no gap after your H1 extension is approved (new H1 effective date will be 9/30/2009, the same date of your old h1 expiration).
