昨天被雷,現在正在準備轉H4,律師給的材料LIST上說除了給USCIS寄一份I-539的材料,還要給 Kentucky Consular Center也寄一份,

誰知道需要給Kentucky Consular Center寄嗎?
-That is for the Petition Information Management Service, known as PIMS which is required for H, L, O, P visa.

今天跟律師談,我說公司願意讓我用unpaid vacation,然後過一個月再發最後一張paycheck.但是律師說實際上從昨天被雷,我已經out of status了,所以必須馬上轉H4,還要給Kentucky Consular Center寄一份材料,這樣他們會加快處理我的申請,否則可能要出境轉身份....
-Eevn if you are out of status as the lawyer said, so what? You are still lawful presence until your current I-94 expires. Also, you still can do your H1 transfer as long as you find a job within one to two months and get it approved with I-94 because USCIS is not strict in this issue. Finally, you can just visit China and get an H4 visa to come back before your current H1 I-94 expires and you have no problem to get the visa.

So, not need to be panic.
