H1 holder 自雇問題 is somewhat complicate. In your case, I suggest you to use EAD to work in your own company and that will be not a problem at all. The only thing you need to concern is that your new working area in your own company has to be the same/similar area as the one you indicated in your I-140.

請問有關H1B自雇問題：

1. I140已批，485PENDING期間，被LAY OFF,可否成立公司自雇？
-Yes.
2. 可否擁有股份並領取薪水，分紅等？
-Yes.
3. 可否將H1B轉入到自雇公司？ 如果被RFE 的話，可否由其他股東簽有關雇用證明？
-Use EAD to work.
